The hearing was called to order at 8:10 p.m.

 

New Case

#1569              Nussbaum, Beth and Kern, Michael                 25 Moose Hill Pkwy.

Applicants seek two findings and two special permits relative to proposed expansion to in a structure on a nonconforming lot.  Property is located at 125 Moose Hill Pkwy. and is situated in the Single Residence A Zoning  within the Ground Water Protection District.

Notice read.

Board of Health letter dated 12/6/06/ read.  Stated the plans for this project have changed and appear to have increased substantially in the number of rooms.  This type of expansion requires a hearing with the Board of Health.

 

Conservation Commission letter dated 12/5/06 read.  No objection.

 

Applicant described plans to add a second floor addition.  On the second floor there will be a Master bedroom suite, full bath room and 2 bedrooms.  On the first floor one of the old bed rooms will be removed to make room for the stairs leading to the second floor. The walls between the other 2 bedrooms will be opened and the walls between the kitchen and the living room will be opened to create an open floor plan.  The half bathroom on the first floor will be removed.

 

The Board request the Applicant to get clarification from the Board of Health.

Applicant seeks a special permit modification to allow a habitable space expansion into the lower level of property within Mac Farms Subdivision.  Property is located 15 Cortland Dr. and is situated in the Suburban 2 Zoning District within Mac Farms Subdivision.

Mr. Yawitch, 20 Orchard Hill Dr. supports the Applicants project.

 

Applicant describes plans to box in the furnace and utilities with dry wall.  This will create storage space.  The finished area will be carpeted.  The Applicant plans to have a small office area and a setting area with a TV.   The proposed living space will be 315 sq. ft..

Laura Nelson, Edge Hill Rd., voiced her concerns with the residents of MacIntosh Farms being able to use there basements.

Applicant seeks a Comprehensive Permit under MGL Chapter 40B, and the Town of Sharon Zoning Bylaws, Article 6, 6230 for development of 180 rental apartment units.  Property is located at 0 and 225 General Edward Hwy.

#1571              Spring Valley Trust                          10 Merchant St.

Applicant requests that the Special Permit dated December 7,1994, issued pursuant to Section6400, 6413, and 4535 in connection with construction of an 11,000sf warehouse addition, be modified to delete Condition 11, which provides that the Special Permit shall expire if the premises are sold.  Property is located at 10 Merchant St. and is situated in the Light Industrial Zone within the Ground Water Protection District.

The Applicant plans to sell the property.

 

The Applicant seeks to have Exhibit A condition 11 stricken from Decision for a Special Permit granted on 12/7/1994.  Which states special permit shall expire should the tenant vacate premises or the premises are sold.

 

Mr. Murphy the buyer for the property states in will be used for distribution or a storage facility.

 

John made a motion to strike Exhibit A condition 11 in Decision for a Special Permit granted on 12/7/1994.
